New Guidelines on State aid for climate, environmental protection and energy 2022

The Commission has adopted new Guidelines on State aid for climate, environmental protection and energy (CEEAG) 2022 which replace the Guidelines for the period 2014-2020.

These new Guidelines are applicable since 27 January 2022 and will allow Member States to support the objectives of the European Green Deal while limiting as far as possible the distortive effects on competition. They apply to both aid schemes and individual aid.

In particular, they broaden to new sectors the categories of investments and technologies that can be supported by Member States. Any aid granted to facilitate the development of economic activities which improve environmental protection as well as any aid in the energy sector governed by the Treaty falls within the scope of the new Guidelines (clean mobility, deployment of renewable energy, etc.).

The new Guidelines are more flexible and simplify the existing rules. They also introduce certain safeguards such as the obligation of public consultation above certain thresholds.

Finally, the new Guidelines ensure consistency with EU legislation and policies, notably through the phasing out of support measures for fossil fuels.
