In anticipation of the entry into force of the Foreign Subsidies Regulation (FSR) on 12 July 2023, the European Commission has today adopted its implementing rules.
The Implementing Regulation, which includes forms for notifying the Commission of mergers involving foreign financial contributions and for reporting foreign financial contributions in public procurement processes, outlines the reporting obligations and the information that needs to be included in the notification forms.
In addition, the implementing rules cover the details regarding the conduct of proceedings by the Commission and the investigation process, the procedural rights of the parties involved, and the calculation and suspension of time limits for providing information and submitting commitments.
