On 6 February, the Commission invited stakeholders to give feedback on the implementation of the Foreign Subsidies Regulation (“FSR”) which aims to combat distortions caused by subsidies granted by third countries to companies operating within the EU market.
The draft Implementing Regulation clarifies the information required in the notification forms for concentrations and public procurement procedures, rules on the calculation of time limits and on access to the file, as well as the rights of the parties.
The Commission seeks feedback from all interested parties on the draft Implementing Regulation on the dedicated portal until 6 March 2023. All the comments received will be taken into account to adopt the rules in the second quarter of 2023, before the start of application of the FSR on 12 July 2023.
